Chapter 151 ADDRESS: RD #2, Box 2456 (Act 250) Brandon, VT 05733 and John Swinington Box 2094 Brandon, VT 05733 The Vermont Environmental Board hereby issues Amended Land Use Permit #9A0192-2-EB pursuant to the authority vested in it by 10 V.S.A. Chapter 151. This permit amendment applies to the lands identified in Book 27, Page 280 and Book 31, Pages 350-351 of the land records of the Town of Leicester, Vermont, as the subject of a deed to John Swinington and as further subject to a lease agreement by and between John Swinington and Talon Hill Gun Club. This permit specifically authorizes the Permittees to relocate and/or reorient several sporting clays shooting stations to allow for shooting in a direction not greater than 45 degrees to the south of magnetic west and not greater than 45 degrees to the east of magnetic north; use, on a temporary basis, an access road off the Leicester-Whiting Road; and install and operate an archery facility. The Permittees and their assigns and successors in interest are obliged by this permit to comply with the following conditions: 1. The project shall be completed, operated and maintained in accordance with: (a) the terms and conditions of Land Use Permit #9A0192-2 (Revised), except as amended hereby; (b) the plans, exhibits, and testimony submitted by the Permittees to the Environmental Board; (c) Findings of Fact and Conclusions of Law #9A0192-2-EB; and (d) the conditions of this permit. No changes shall be made in the project without the written approval of the District #9 Environmental Commission. 2. Condition 12 of Land Use Permit #9A0192-2 (Revised) is deleted. New Condition 12 is added. It reads: The Commission shall have: (a) continuing jurisdiction over the noise impacts of this project; (b) the right to conduct random, unannounced site visits; and (c) the right to conduct public hearings for the purpose of reviewing unanticipated impacts under Criteria 1 (air-noise pollution) and 8 (aesthetics) if it concludes, at its sole discretion, that there is a substantial demonstrable increase in noise generated by the Gun Club over that which is established in Diane Muhr's report entitled: Sound Survey Talon Hill Gun Club February 26, 1994.
