Chapter 151 Re: Joseph & Sylvia Palmisano Land Use Permits #5W0883-EB and #5W0883-1-EB (Revocation) DISMISSAL ORDER On April 8, 1994, a petition to revoke Land Use Permit #5W0883 and amendment #5W0883-1 was filed with the Environmental Board by Gyles and Beverly J. Warren (Petitioners) through their attorney, Richard Brock, Esq. Land Use Permit #5W0883, issued by the District #5 Environmental Commission on June 26, 1986, authorized Joseph and Sylvia Palmisano (Permittees) to construct a 2,000 square foot office building with related improvements. The 3.2 acre site is located off East Road (T.H. 57) and the South Barre Interstate Access Road (VT Route 63) in the Town of Berlin, Vermont. Land Use Permit Amendment #5W0883-1, issued on April 30, 1992, authorized the Permittees to construct a two-room, 35 foot by 18 foot addition to the basement of an existing commercial building, and to retain previously-installed exterior building lighting which was not specifically approved in the prior permit. On April 22, 1994, Lyndonville Savings Bank & Trust Co. (Bank), as successor in interest to the Permittees, filed an Opposition to Permit Revocation Petition with the Board. On March 16, 1995, the Board received a Stipulation of Dismissal from the Bank and the Petitioners. The stipulation states that the petition in this matter may be dismissed with prejudice. The Board deliberated on April 26, 1995 in Montpelier and decided that dismissal of this matter is not contrary to the values embodied in Act 250. This matter is dismissed with prejudice.
