Re:  Fayston Farms Homeowners' Association,
     Land Use Permit Amendment #5W0375-8-EB

                      DISMISSAL ORDER

       On August 29, 1995, Alexander G. and Mary Ann Moniodis ("Appellants")
  filed documents which they characterized as an appeal ("Appeal") with the
  Environmental Board from the District #5 Environmental Commission's August
  3, 1995 Land Use Permit Amendment #5W0375-8 and supporting Memorandum of
  Decision.  On September 20, 1995, the Board scheduled a prehearing
  conference concerning the Appeal for October 3, 1995 at the Board's offices
  in Montpelier.

       On September 29, 1995, the Appellants filed a letter with the Board in
  which they requested that the Appeal be dismissed ("Dismissal Request"). 
  The Dismissal Request is incorporated herein by reference.  The October 3,
  1995 prehearing conference was cancelled.  On October 4, 1995, Board Chair
  John T. Ewing advised the parties that the Board would deliberate on the
  Dismissal Request on October 18, 1995 and that any party wishing to comment
  in support of or in opposition to the Dismissal Request could do so on or
  before October 11, 1995.  No submittals were received by the Board as of
  October 18, 1995.

       On October 18, 1995, the Board deliberated on the Appeal.  Upon
  consideration of all the filings in the Appeal, the Board hereby orders
  that the Appeal is DISMISSED.
