     Re:  Mt. Mansfield Co., Inc. d/b/a Stowe Mountain Resort
          Land Use Permit #5L0646-3-EB (Revocation)
     
                           DISMISSAL ORDER
     
    This decision pertains to a revocation proceeding brought by Joseph F.
  Welch (the Petitioner), an adjoining landowner, against Mt. Mansfield Co.,
  Inc. d/b/a Stowe Mountain Resort (the Permittee) with respect to a permit
  issued for a summer concert series.  The Petitioner alleged that, in
  submitting an application for that permit, the Permittee failed to comply
  with Environmental Board Rule 10(F) by failing to furnish his name and the
  name of other adjoining landowners to the District #5 Commission.
     
    On June 7, 1994, the Petitioner filed a motion to withdraw.  Also on that
  date, the Permittee filed a letter urging that the Board accept the
  withdrawal.
     
    The Board deliberated on June 8, 1994 in South Royalton, Vermont and
  decided that dismissal of this matter is not contrary to the values
  embodied in Act 250.  This matter is dismissed.
