Chapter 151 RE: East Williston Road Associates and and Paul and Helena Blair Land Use Permit #4C0388-A-11-H3-EB DISMISSAL ORDER On August 31, 1994 the District #4 Environmental Commission issued Land Use Permit Amendment #4C0388-A-11-H3, and supporting Findings of Fact, and Conclusions of Law (the Permit). The Permit authorizes East Williston Road Associates and Paul and Helena Blair (the Permittees) to construct a 3,000 square foot drive-in bank, an 18,000 square foot 3 story office building with associated parking and driveways, and a 600 foot road to be dedicated to the Town of Williston linking Routes 2 and 2A (the Project). The Project will be located on a new 1.46 acre lot (Lot 1A) with an additional .8 acre right- of-way created for the road from a portion of two previously permitted lots (Lots #12 and #13) in Blair Park in the Town of Williston, Vermont. On September 30, 1994 the Judge Companies (the Appellant) filed an appeal with the Environmental Board from the Permit. The Appellant contends that the District Commission erred by failing to make the Town of Williston a co-applicant pursuant to Board Rule 10(A), and with respect to 10 V.S.A.  6086(a)(5) (traffic), and (10) (conformance with local and regional plan). On December 1, 1994 the Appellant withdrew its appeal. The Board deliberated on January 4, 1995, and decided that dismissal of this matter is not contrary to the values embodied in Act 250. The Appellant's appeal is dismissed with prejudice. Dated at Montpelier, Vermont, this 5th day of January, 1995.
