RE: Black River Valley Rod & Gun Club, Inc., #2S1019-EB, Recess Order (Oct. 2, 1996) VERMONT ENVIRONMENTAL BOARD 10 V.S.A. §§ 6001-6092 Re: Black River Valley Rod and Gun Club, Inc. Application #2S1019-EB RECESS ORDER On September 5, 1996, the Environmental Board ("Board") held a hearing in this matter. The Board deliberated on September 5, 1996 and September 25, 1996. Pursuant to Environmental Board Rule ("EBR") 20, the Board hereby recesses this proceeding and orders as follows: 1. On or before November 7, 1996, the Black River Valley Rod & Gun Club ("Club") shall submit to the Board membership records per annum for the years 1986 through 1996 and any other supplementary data and/or testimony regarding the number of Club members during the years 1986 through 1996. 2. On or before November 7, 1996, the Club shall submit to the Board receipts and/or bills regarding the Club's expenditures per annum on clay pigeons for the trap range during the years 1986 through 1996 and any other supplementary data and/or testimony regarding the Club's expenditures on clay pigeons during the years 1986 through 1996. 3. On or before November 7, 1996, the Club shall submit to the Board supplementary data and/or testimony regarding the use of the trap and rifle ranges on a per annum basis during the years 1986 through 1996, including (a) any logs kept which indicate the Club members who use each range, dates of use, and times of use; (b) the percentage of Club members who use the trap range; (c) the percentage of Club members who use the rifle range; and (d) the percentage of Club members who use both the trap and rifle ranges. 4. On or before November 7, 1996, the Club shall submit to the Board supplementary data and/or testimony regarding generally available mitigating steps to improve the harmony of the Club with its surroundings by reducing noise. 5. The Board hereby provides to each party, other than the Club, 20 days to respond to the Club's supplementary data and/or testimony with rebuttal data and/or testimony. 6. All supplementary data and testimony submitted to the Board shall be distributed to each party identified on the attached certificate of service. 7. After the completion of submission of the above supplementary evidence by all parties, the Board will convene another hearing in this matter. The Board will supplement this Order with a subsequent notice of hearing date, time and location. 8. Pursuant to EBR 20, the Board may conduct its own investigation and require tests, witnesses or other assistance regarding mitigating steps generally available to shooting clubs to improve their harmony with their surroundings by reducing noise. Pursuant to EBR 4, the Board may issue subpoenas for the attendance of witnesses and/or the production of documents. Dated at Montpelier, Vermont this 2nd day of October, 1996.
