Chapter 151 RE: Barre City Property of Northfield Savings Bank Declaratory Ruling #299 DISMISSAL ORDER On August 25, 1994, the Northfield Savings Bank (the Petitioner) filed an appeal from Advisory Opinion #EO-93-295 and petitioned for a declaratory ruling as to whether 10 V.S.A. Chapter 151 (Act 250) applied to remediation activities proposed by the Petitioner with respect to wastes disposed of on a 9.1 acre parcel owned by the Petitioner in the City of Barre, Vermont (the Project). On October 31, 1994, the Petitioner filed a letter with the Board and requested that the petition be dismissed. In support of its request, the Petitioner stated that it intends to apply for an Act 250 permit in the immediate future to allow adequate time for the district commission process to run its course and, thereafter, to allow sufficient time to implement the permit requirements before the Barre City Elementary School is occupied in the fall of 1995. The Board deliberated on November 9, 1994, and decided that dismissal of this matter is not contrary to the values embodied in Act 250. This matter is dismissed with prejudice.
